BLS OEWS is the backbone of wage-earning-capacity work. Here's how to query it by SOC code and geography — and cite it correctly.

When the Wrong Wage Number Sinks the Report

A vocational counselor testifies that a client's post-injury earning capacity sits at the national median wage for a SOC code pulled from memory. Opposing counsel asks a simple question: which area, which year, which percentile. The counselor doesn't have a clean answer, and the number — not the methodology — becomes the thing the court remembers. This happens more often than it should, and almost always for the same reason: BLS OEWS data was cited generically instead of pulled and documented by SOC code, geography, and reference year. What OEWS Actually Measures — and What It Doesn't

The Occupational Employment and Wage Statistics (OEWS) program is the Bureau of Labor Statistics' semiannual survey of employers, and it is the single most-cited wage source in vocational rehabilitation work for a reason: it is occupation-specific, geography-specific, and built from an enormous, recurring sample. BLS constructs OEWS estimates from a probability sample of about 1.1 million establishments, drawn in semiannual panels of roughly 186,000 to 189,000 each (BLS OEWS Technical Note, 2024/2025). That sample size is what makes OEWS defensible as a wage source in a report that may face cross-examination — it isn't a survey of convenience, it's a large, methodologically documented federal program.

What OEWS does not do is tell you what one specific employer pays, or predict what a client will actually be offered. It reports estimated wage distributions for defined occupations in defined areas, for a defined reference period. That distinction matters when you write the report: OEWS output is an estimating tool for a wage range a similarly credentialed worker in that occupation and area could reasonably earn — not a guarantee, and not a substitute for a labor market survey that confirms actual local openings and employer willingness to hire.

Finding the Right SOC Code Before You Query

Every OEWS query starts with a Standard Occupational Classification (SOC) code, and getting the wrong code is the single most common error in wage-earning-capacity work — it produces a wage figure for the wrong occupation entirely, and it's often invisible until someone checks the source. A client's job title rarely maps cleanly to a SOC code; "warehouse lead" and "logistics coordinator" might both belong under the same six-digit code, or under two different ones with materially different wage bands.

This is where a proper crosswalk matters. Pulling BLS OEWS Wage Data by SOC Code and Geography

Once the SOC code is confirmed, the query itself has two more variables that determine whether the resulting wage figure is usable: geography and reference year.

Geography. OEWS publishes wage data at the national level, by state, and by metropolitan and nonmetropolitan area. A national median wage for a SOC code and a metro-area median for the same code can differ substantially, and in wage-earning-capacity work the metro or local area figure is almost always the more defensible one — it reflects the labor market the client actually lives and works in, not an average across every labor market in the country. Pulling the wrong geographic level is a quieter version of the same error as pulling the wrong SOC code: technically sourced, but not actually representative of the client's situation. Reference year. OEWS data is released on a periodic cycle, and every published estimate carries a specific reference period. A report that cites "BLS OEWS data" with no year attached is citing nothing verifiable. Confirm the current release date and reference period directly from BLS before finalizing any report — the exact publication cadence should be checked at the time of the query rather than assumed, since it can shift from one cycle to the next.

Reading the Percentiles Correctly

OEWS doesn't report a single wage number per occupation — it reports a distribution, typically including the 10th, 25th, 50th (median), 75th, and 90th percentiles. Which percentile belongs in a wage-earning-capacity opinion depends entirely on the client's specific profile: education, experience, transferable skills, and any physical or vocational restrictions documented in the case file. A worked example, using a real published OEWS occupation as illustration rather than a client-specific figure: BLS reports rehabilitation counselors had a median annual wage of $46,110 in May 2024, with the lowest 10 percent earning under $34,480 and the highest 10 percent earning over $77,200 (BLS Occupational Outlook Handbook, May 2024). If you were analyzing a client whose experience and credentials placed them at entry level for a given occupation, anchoring to the median — or even the 25th percentile — would be a more defensible estimate than reaching for the top decile; the opposite is true for a highly experienced client re-entering a familiar field.

The percentile choice is a judgment call the credentialed practitioner has to make and be prepared to explain — the OEWS table supplies the range, not the answer. Citing the Reference Year So the Number Survives Cross-Examination

A wage figure that shows up in a report without its source, geography, and reference year attached is an invitation to be discredited. The citation format that holds up under scrutiny includes, at minimum: the SOC code and title, the geographic area queried, the percentile used, and the OEWS reference year — for example, "SOC 21-1015 Rehabilitation Counselors, [metro area], median annual wage, BLS OEWS, [reference year]." That level of specificity does two things: it lets opposing counsel or a reviewing adjuster verify the number independently, which builds credibility rather than inviting challenge, and it protects the practitioner if the case resurfaces months or years later and the underlying OEWS release has since been updated. Because fee-schedule rules, evidentiary standards, and reporting formats vary by jurisdiction, confirm citation requirements with the relevant workers' compensation board, carrier, or court before finalizing report language — a citation format acceptable in one jurisdiction is not automatically acceptable in another.

Building the Number Into a Wage-Earning-Capacity Analysis

A correctly sourced OEWS wage figure — right SOC code, right geography, right percentile, right reference year — is one input into a wage-earning-capacity analysis, not the whole analysis.
